APS 10.13 Noncompliance

Youth Activity or Research Noncompliance

If an activity or research study involving youth does not meet APS 10.13 requirements, the activity leader or principal investigator and department head listed in YPRS will be notified by email. They must act quickly to resolve any issues.

    • Never allow personnel unsupervised access to minors if they haven’t completed required tasks.
    • Activity leaders, PI’s or their designees must take the steps outlined in the following links to keep YPRS updated and resolve noncompliance.

Unit noncompliance

Compliance Improvement Period

A unit that does not meet APS 10.13 compliance expectations as determined by the University will be moved into a Compliance Improvement Period (CIP). A unit head (e.g., chancellor, dean, vice president, vice provost) will be notified of this status by the Office of the Youth Protection Coordinator via e-mail upon publication of Youth Activity Compliance Reports, biannually in April and October.

What happens during the Compliance Improvement Period?

  • The Compliance Improvement Period lasts six months, until the end of the next reporting period.
  • The unit head will be asked to designate an administrative leader to oversee improvement efforts within the unit and to serve as a point of contact with the Office of the Youth Protection Coordinator.
  • The Office of the Youth Protection Coordinator will be available to meet with the unit head and their administrative designee and answer any questions throughout the Compliance Improvement Period.
  • The unit’s compliance will then be reassessed at the end of the six-month period.
    • If the unit is meets the minimum compliance expectation (at least 80% of registered activities fully compliant) at that time, the Compliance Improvement Period will end and the unit will be expected to continue to maintain compliance.
    • If there is measurable improvement but the unit has not yet met compliance expectations, the Compliance Improvement Period will be extended for an additional six months.
    • If there is no measurable improvement from the unit, the Compliance Improvement Period will be extended and the Youth Protection Coordinator will elevate the matter to the Executive Office.
